4.6. Distance Requirements

Policy

  • small acts may agree to work closer than the requirement for separation

  • businesses or carts may agree to let Performer closer than requirement

  • if complaints or conflicts, the distance restrictions should be applied

  • carts and stores should be guaranteed access through a performers audience

  • too great a "thinning" by separation of Performers will affect overall quality by limiting access to quality acts (who have other venue options)

4.6.1. Distance requirements make sense when one performance is causing a conflict with another or if the Performer or audience is causing difficulty for businesses or carts. Many Performers make efforts to communicate with and respect others in their performance area and thus cause little conflict. Some Performers are less sensitive and distance requirements may help to provide guidelines for their integration into the community.

4.6.2. It is the belief of the Performers that if two acts with small audiences (a painter and a balloon clown) agree to work closer than a possible requirement , and cause no conflict for others, there is no point in separating them a required distance. Similarly, if a Performer and a business or cart have an agreement to work closely together and cause no conflict for others, the Performer should be allowed to remain.

4.6.3. If a Performer has a larger audience or produces sound levels which may interfere with others and causes complaints, it then seems appropriate to enforce distance requirements.

4.6.4. A Performer's audience should not block the access to a vending cart or a business entry. For carts, at least the three main display sides should be open to the public.

4.6.5. It is understood that appropriate location and distance requirements are a constitutionally acceptable way to "thin out" Performers; however, if too restrictive, they may force out the better Performers.
