4.4. Length of Performance

Policy

  • different Performers need access to the same location

  • businesses and residents in fixed locations may need relief from a specific performance

  • Performers need relief from chronic complainers

  • there should be varying criteria for judging length of performance

  1. if no legitimate complaint, no other Performer waiting: performance length unlimited

  2. if another Performer is waiting: performance length of one hour

  3. legitimate complaint (without violating regulations), no other Performer waiting: performance length two hours

4.4.1. There is a need to provide access to the greatest number of Performers and to provide relief for businesses and residents who may not appreciate the artistic merit of a particular performance. However, there are occasional chronic complainers who dislike everything. Performers should have some relief from these individuals in return for the regulation standards under which they operate.

4.4.2. There are many types of Performances which require differing amounts of time. The roving balloon clown may need only a few minutes at a particular location while the portrait painter may require several hours to finish a work. A juggler or magician has a tight, thirty minute act, culminating with the "passing of the hat" to a large crowd. The folk singer has constantly shifting audience members who stay for several songs each - thus, the folk singer needs a longer set than the juggler to be successful.

4.4.3. The application of a time limit for performances makes sense to satisfy the needs for access and relief, but this regulation should be applied by a flexible standard based on the following criteria:

  • If there are no legitimate complaints and there is no other Performer wishing to use the location, a performance may continue as long as desired.

  • If a performance space is desired by another Performer the length of performance should be one hour from when the Performer started.

  • If a Performer receives a legitimate complaint based on no other criteria than content of performance, is not violating other regulations and no other Performer desires the spot the length of performance should be two hours from when the Performer started.
